We have received complaints that your products are not compliant with the Waste Electrical and Electronic Equipment Regulations 2013 (“WEEE Regulations”).
Upon registering as a Seller on the Amazon Marketplace, you agreed certain terms within the BSA, including:
S-1.1 Products and Product Information:
You will also ensure that Your Materials, Your Products (including packaging) and the offer and subsequent sale of any of the same on any Amazon Site comply with all applicable Laws (including all minimum age, marking and labelling requirements).
This compliance with all applicable laws includes the WEEE Regulations when selling electrical or electronic equipment within the United Kingdom.
If you do not take steps to address the reported non-compliance within 30 days, then your listings will be removed from the Amazon Marketplace.
To assist, please see below a summary of the WEEE obligations; however please note that this information is not exhaustive, may change and it remains your responsibility as a Seller to understand in full and comply with the WEEE Regulations.
Producer obligations:
If you qualify as a producer your obligations include the following:
? If you place less than 5 tons of EEE on the UK market in a calendar year, you must register as a small producer with the relevant UK environmental regulator for your business location (England = Environment Agency, Wales = Natural Resources Body for Wales, Scotland = Scottish Environment Protection Agency, Northern Ireland = Department of the Environment, outside of UK = contact the Environment Agency on WEEE@environment-agency.gov.uk to confirm).
? If you place 5 tons or more of EEE on the UK market in a calendar year you must become a member of a producer compliance scheme ("PCS"). The PCS will discharge your obligation to finance the collection, treatment, recovery and disposal of household and non-household WEEE collected in the UK (see further below). ? Provide your producer registration number to any distributors to which you supply.
Distributor obligations:
Your take-back obligations may be satisfied, by:
? joining the Distributor Take-back Scheme (further information is available on its website); or
? providing free take-back on a 1:1 basis when supplying new EEE of an equivalent type and purpose by either:
o offering an equivalent service to in-store take-back (e.g. a postal solution); or
o providing an alternative free take-back service, which is available and accessible to customers, e.g. provision of a designated collection facility where customers can take WEEE. This means either establishing a private designated collection facility or making arrangements with a PCS.
